Terms of Service

These Terms of Service ("Terms") govern your access to and use of StampWise (the "Service"). By creating an account or using the Service, you agree to these Terms.

1. The Service

StampWise provides digital loyalty stamp cards, customer wallets, scanning tools, and related analytics for businesses ("Merchants") and their customers ("Customers").

2. Accounts

You must provide accurate information and keep your credentials confidential. You are responsible for activity on your account. You must be at least 18 years old (or the age of majority in your jurisdiction) to create a Merchant account.

3. Free trial and subscriptions

New Merchant accounts include a 14-day free trial. After the trial, continued use of paid features requires an active subscription. Subscriptions renew automatically until canceled. You may cancel at any time from your account settings; cancellation takes effect at the end of the current billing period. Fees already paid are non-refundable except as required by law.

4. Acceptable use

You agree not to:

• Use the Service to violate any law or third-party right
• Send spam, deceptive messages, or unauthorized marketing
• Abuse the referral program or attempt to fraudulently obtain rewards
• Reverse engineer, scrape, or interfere with the Service
• Upload malware or attempt to bypass security or rate limits

5. Merchant responsibilities

Merchants are the data controllers for their Customers' information. Merchants are responsible for (a) honoring rewards advertised on their cards; (b) providing accurate descriptions of stamps, rewards, and referral bonuses; and (c) complying with applicable laws including consumer protection and privacy laws.

6. Customer accounts

Customers join individual loyalty cards by providing the information requested by the Merchant. Stamp balances and rewards have no cash value and are governed by the issuing Merchant's program rules.

7. Intellectual property

StampWise and its content (excluding Merchant or Customer data) are owned by us and protected by intellectual property laws. We grant you a limited, non-exclusive, non-transferable license to use the Service in accordance with these Terms.

8. Termination

We may suspend or terminate accounts that violate these Terms or pose risk to the Service or other users. You may close your account at any time.

9. Disclaimers

THE SERVICE IS PROVIDED "AS IS" WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS OR IMPLIED, INCLUDING MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.

10. Limitation of liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, STAMPIT SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, OR CONSEQUENTIAL DAMAGES. OUR TOTAL LIABILITY ARISING OUT OF THE SERVICE SHALL NOT EXCEED THE AMOUNTS YOU PAID TO US IN THE 12 MONTHS PRECEDING THE CLAIM.

11. Indemnification

You agree to indemnify StampWise against claims arising from your misuse of the Service or violation of these Terms.

12. Governing law

These Terms are governed by the laws of the jurisdiction in which StampWise is established, without regard to conflict-of-laws rules.

13. Changes

We may update these Terms from time to time. Material changes will be notified by email or in-app notice. Continued use after the effective date constitutes acceptance.
